I would have waited for a clear road behind, accelerated backward so he fell off the car, then driven past him. Then just keep the proof and wait and see if anything comes by way of a summons...

Incidentally, was anyone holding their breath hoping he got wiped out by a passing car as the driver made him walk to the side?
